1. What this software is
SoftClinic GenX HIMS is a Hospital Information Management System used by a registered healthcare facility to run its clinical and administrative operations and to interoperate with India's Ayushman Bharat Digital Mission (ABDM) — creating and verifying ABHA identities, sharing health records as a Health Information Provider, and retrieving records as a Health Information User.
2. Who may use it
Authorised staff of a facility with a valid agreement, registered on the Health Facility Registry. Accounts are personal to the individual staff member.
3. Your account
- Do not share your password or let anyone else use your account. Actions taken under your login are attributed to you in the audit trail.
- Roles are least-privilege by default: ADMIN, RECEPTIONIST, DOCTOR, AUDITOR. Use only the access you have been granted.
- Report a suspected compromise immediately.
4. Acceptable use
You must not:
- access a patient's records without a clinical or administrative reason to do so;
- create or verify an ABHA without the patient present and consenting;
- share, export or retain patient data beyond what your role and the law permit;
- attempt to bypass access controls, tamper with the audit trail, or probe the system without written authorisation;
- use the system for any purpose other than the facility's own healthcare operations.
5. The facility's responsibilities
As Data Fiduciary under the DPDP Act, the facility is responsible for:
- obtaining genuine, informed patient consent before ABHA creation and before sharing records — the consent tick-boxes in this software record a decision, they do not make it for you;
- the accuracy of the data its staff enter;
- training its staff, and revoking access promptly when someone leaves;
- complying with ABDM/NHA policies and its own clinical-record retention obligations.
6. Data and confidentiality
Patient data belongs to the patient and is held by the facility. JVS processes it only to provide the service and only on the facility's instructions — never for our own purposes. How the software handles data is set out in the Privacy Policy. Both parties keep the other's confidential information confidential.
7. Availability
The ABDM-facing features depend on the ABDM gateway, which we do not operate. Where a written agreement sets service levels, those apply; otherwise the software is provided without a guaranteed uptime commitment.
8. Intellectual property
The software is licensed, not sold. JVS retains all rights in it. You may not copy, reverse-engineer or redistribute it except as your agreement or law permits.
9. Liability
To the extent permitted by law, JVS is not liable for clinical decisions, for data your facility enters incorrectly, or for failures of the ABDM gateway or other third-party systems. Nothing here limits liability that cannot lawfully be limited. Any agreed financial limits are those in your written agreement with JVS.
10. Termination
Access ends when your agreement ends or when your account is withdrawn. On exit, the facility's data is returned or erased as that agreement provides, subject to the erasure limits explained in the Privacy Policy.
11. Governing law
These terms are governed by the laws of India. Jurisdiction is as set out in your written agreement with JVS.
